have with you and the property during your tenancy.

Is
there a 'standard' house lease contract in Vietnam?
No, most landlords prepare their own lease contracts
although Vietnamese law certain key clauses to be included. Lease
contracts will be in Vietnamese although there is usually an English
translation - the Vietnamese version will be controlling. Some
landlords insist on signing two contracts - a lease contract and a
service contract - in order to reduce their tax liabilities.
Contracts can either be signed by a
resident's sponsor, usually the employer, or by an individual who
has permission to stay in Vietnam for six months or longer.
Generally once you and the property owner have come to a basic
agreement (i.e. rent, starting date, etc.) a draft of the contract
will be faxed to you or the person in your company in charge of such
matters. Particulars of the lease agreement may need to be
negotiated after which two formal copies of the lease agreement will
be made to be signed and held by each party.

What
are typical leasing terms?

Advance rent
|
The first rental payment will
usually vary between three to 12 months, depending upon the
size and location of the property. Thereafter, rent is
typically paid quarterly in advance.

Deposit
|
Security deposits are not yet
commonly required for houses.
|
|
Service Charges
|
Any service or maintenance fees
are almost always included in the monthly rent.
|
|
Duration
|
House lease contracts are
generally for one to two years.

Break Clauses
|
Break clauses are usually
possible in the case that the tenant is transferred away
from the city of residence or the organization for which the
tenant works closes down. Wider clauses can be negotiated in
some cases. Two months notice is usually required for
cancellation.

Utilities
|
Power, water, gas and telephone
charges are typically the responsibility of the tenant
although you should ensure that there is no 'service fee'
added to consumption charges. Your Binh Minh Real Estate
agent will help make the arrangements for utility
connections if required.

What
furnishings will be supplied ?
Houses leased on a long term basis are
usually furnished with major items of furniture including beds,
dining tables, sofa sets, armchairs, etc. although the range and
quality of the furnishings will vary from property to property. Your
Binh Minh Real Estate agent will discuss with you the furnishing
options available and confirm your requirements regarding what is
supplied in the property to best suit your needs.
Kitchen appliances such as
refrigerators and stoves are provided. Clothes washers, dryers and
microwaves are sometimes provided, but dishwashers are not common.
Almost all accommodation is
air-conditioned with split units, with tenants paying for the
electricity consumed.
Tenants have to provide their own
linen, crockery, cutlery.
How
will the inventory be performed?
The landlord may choose to organize the inventory or this may
be done through Binh Minh Real Estate. Although most landlords don't
require a security deposit when renting a house, the tenant is
legally responsible for any damages to the property and the landlord
may attempt to reclaim the cost of damages before you move out. A
professionally conducted inventory at the start of the lease will
help prevent any later disputes - ask your Binh Minh Real Estate
agent for advice on making an inventory.
Will
the property have a television?
Televisions are not generally included in a house lease, however, it
should be possible to negotiate for one if necessary. Many house
owners have already installed satellite television in their
properties although they may require the tenant to pay for certain
satellite subscription fees.
Telephone
lines
Most houses have an installed IDD line with an assigned number which
the new occupant usually assumes. You should carefully check on
invoicing arrangements, however, and responsibilities for line
connection if a property needs to have any new lines installed.
Parking
Not many houses have garages and parking spaces, if any, are usually
in a driveway or forecourt. If you have a car and intend to park at
home, also check that vehicle access is physically possible, even if
your house has a garage - some roads in Vietnam are impossibly small
to navigate!
